will regularize their “illegal” homes for free
Those property owners who bought their properties in good faith (as the Town Hall calls them) acquiring their homes in the ignorance of their illegality, will be exempt from any payment to get their homes legalized. Therefore, the new regulation forces the Developers to take on that responsibility. This new measure affects around 16.500 property owners.
The Developers are now the ones to affront the compensations. Some of these compensations will be made in cash and some others in land. The question now is, what happens if the Developers were missing or in bankruptcy? In those cases, there will be various organisms of the Spanish Administration “not only the Marbella´s Town Hall...” as the town councilor affirmed, who will take on that. He also explained that, the Community of Owners under these circumstances, are at these times, apt to apply for the First Habitation License of those properties to be regularized and the Licenses would be granted shortly. In addition, he asserted that the owners of the properties in that situation are perfectly able to exercise their rights: buying and selling, setting up mortgages, contracting any kind of supplies (water, electricity, etc.)
Those properties that, today are not in possession of the First Habitation License, are therefore in right conditions to start the necessary dealings to achieve it. Obviously, there is a specific procedure to be followed for the peace of mind of many Communities who have been waiting ages for this moment.
On the other hand, there are still 1.500 properties that are kept out of the PGOU. These will not be able to follow the procedures above mentioned as they were not considered as apt for it. One thousand of them are empty and five hundred of them are inhabited, being Banana Beach the one with the higher number of these properties.
